By accessing our website, requesting a service estimate, scheduling a service appointment, or engaging our HVAC services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, please do not use our website or services.

2. Services Description

Rodriguez Climate Control LLC provides heating, ventilation, and air conditioning (HVAC) services including but not limited to:

• Installation and replacement of residential and commercial HVAC systems
• Repair and diagnostic services for all HVAC equipment brands
• Preventive maintenance and tune-up services
• Ductwork installation, repair, and sealing
• Thermostat and controls installation and programming
• Indoor air quality system installation and service
• Emergency HVAC repair services
• Free estimates for new equipment installations

All services are subject to availability, geographic service area, and technician scheduling. Rodriguez Climate Control LLC reserves the right to decline service requests at its sole discretion.

3. Website Use and User Responsibilities

By using our website, you agree to the following:

• You will provide accurate and complete information when submitting service requests or contact forms.
• You will not use our website for any unlawful purpose or in violation of any applicable laws.
• You will not attempt to gain unauthorized access to any portion of our website or systems.

5. HVAC Service Agreements

When you schedule HVAC service with Rodriguez Climate Control LLC, the following terms apply:

• A written estimate or service authorization will be provided before work begins on repairs exceeding $200.
• Diagnostic fees apply to repair service calls and will be disclosed before the technician visit.
• Estimates for new installations are provided at no charge and are valid for 30 days from the date of issue.
• Work will not begin until the customer has authorized the service in writing or verbally with confirmation.
• All work will be performed in a workmanlike manner consistent with industry standards.
• Technicians will clean up their work area upon completion of service.
• The customer must provide safe, reasonable access to all equipment requiring service.
• Rodriguez Climate Control LLC is not responsible for pre-existing conditions discovered during service.

6. Payment Terms

Payment terms for Rodriguez Climate Control LLC services are as follows:

• Payment is due upon completion of service unless other arrangements have been made in advance.
• We accept cash, check, and major credit cards (Visa, Mastercard, American Express, Discover).
• A deposit may be required for new equipment installations, typically 50% of the total project cost.
• Returned checks are subject to a $35 returned check fee.
• Accounts outstanding more than 30 days may be subject to a late fee of 1.5% per month.
• Rodriguez Climate Control LLC reserves the right to require payment in advance for customers with prior payment issues.
• Financing options may be available for qualifying customers through third-party financing providers.

7. Scheduling Policies

Service appointments are scheduled based on technician availability. We provide estimated arrival windows and will make every reasonable effort to arrive within the scheduled window. Traffic, weather, and the variable duration of prior service calls may affect arrival times. We will contact you if we anticipate a significant delay. Customers should be available or have an authorized adult present during the service appointment. Cancellations should be made at least 24 hours in advance when possible. 8. Service Availability and Geographic Limitations

Rodriguez Climate Control LLC primarily serves the Dallas-Fort Worth metropolitan area and surrounding communities in North Texas. Service availability outside our primary service area is subject to technician availability and travel time. We reserve the right to decline service requests outside our standard service area or to charge additional travel fees for distant locations. Emergency service is available 24/7 within our primary service area; response times for locations outside the primary service area may be longer.

9. Warranty Disclaimers

Rodriguez Climate Control LLC warrants our labor and workmanship for 90 days from the date of service on repair work. New equipment installations are covered by the manufacturer's equipment warranty, which varies by manufacturer and product. The following conditions void our labor warranty:

• Repairs, modifications, or adjustments made by unauthorized parties after our service
• Failure to perform recommended maintenance
• Damage caused by power surges, floods, fire, or other external events
• Improper use or operation of equipment
• Normal wear and tear on consumable components

EXCEPT AS EXPRESSLY SET FORTH HEREIN, RODRIGUEZ CLIMATE CONTROL LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RODRIGUEZ CLIMATE CONTROL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATED TO OUR SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rodriguez Climate Control LLC, its owner, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our website or services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any inaccurate information you provided to us in connection with requesting or receiving services.

12. Dispute Resolution

In the event of any dispute arising out of or related to these Terms or our services, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Dallas County, Texas. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you hereby consent to the personal jurisdiction of such courts.

14. Changes to Terms

Rodriguez Climate Control LLC reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
